Terms of Use

These Terms of Use (“Terms”) govern your use of the Lexum website and the Lexum mobile application (together, the “Service”). By accessing or using Lexum, you agree to these Terms.

Lexum is operated by Michael Vyhivskyi (ФОП Вигівський Михайло Вікторович), an individual entrepreneur registered in Ukraine.

About Lexum

Lexum provides translation and vocabulary learning tools designed to help you discover, organize, and retain new words. Some parts of the Service may be in early access or pre-release stage and may change over time.

Beta and early access

Lexum is currently in closed testing. Beta builds are distributed through Apple TestFlight and Google Play closed testing, and your participation is also subject to those platforms' own terms.

• Beta builds are pre-release software: they may be unstable, incomplete, or change without notice.
• Features available in a beta build may be altered or removed before general release.
• Beta data may need to be reset. We will warn you by email before any planned reset, but we cannot guarantee beta data against loss.
• We may end the beta, or withdraw an individual tester's access, at any time — for example for abuse of the Service.
• Joining the waitlist does not guarantee an invitation or a specific date; we invite testers in batches.

Founding Users

The first 50 people who confirm their email address on the beta waitlist become Founding Users. What that includes is set out in full on our Founding Users page, which forms part of these Terms. In summary:

• A code for one free month of Lexum Pro, sent by email when Lexum launches on the App Store and Google Play, and redeemed through the relevant store. It does not renew automatically.
• Usage limits above the standard Pro tier, which apply for as long as you hold an active Pro subscription.
• A permanent Founding badge on your profile in the app, which does not depend on a subscription.
• Access to new features ahead of general release.

Founding status is tied to the email address you confirmed, is limited to one per person, and cannot be transferred or exchanged for money. Founding places are limited to 50 and are allocated in the order confirmations are received. If we need to change the Founding limits, we will email Founding Users in advance and explain the reason.

Accounts

Certain features require creating an account. You are responsible for keeping your account secure and for all activity that occurs under your account.

Subscriptions

Some features may be offered through paid subscriptions. Subscriptions are processed by the respective platform provider (Apple App Store or Google Play) and may be managed through RevenueCat.

• Subscriptions renew automatically unless cancelled in your app store account settings.
• Where a free trial is offered, it converts into a paid subscription at the end of the trial period unless you cancel before it ends.
• Promotional free periods redeemed with a code do not convert automatically — they simply end.
• Cancellation takes effect at the end of the current billing period.
• Prices are shown in the app and may vary by region and store. We will give notice of price changes as required by the respective store.
• Refunds are handled according to the policies of the respective app store.

Acceptable use

You agree not to misuse the Service. In particular, you must not:

• use the Service for unlawful purposes
• attempt to access systems or data without authorization
• interfere with, disrupt, or overload the Service
• reverse engineer or attempt to extract source code except where permitted by law

Content & intellectual property

The Service, including its design, text, graphics, and software, is owned by Lexum or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without permission, except where allowed by law.

Service availability

We aim to keep the Service reliable, but we do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, updates, or third-party outages.

Disclaimer

The Service is provided “as is” without warranties of any kind. Translation outputs and learning recommendations may contain inaccuracies and are provided for informational purposes.

Limitation of liability

To the maximum extent permitted by law, Lexum will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Termination

You may stop using Lexum at any time. We may suspend or terminate access to the Service if you violate these Terms or misuse the platform.

Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after changes means you accept the updated Terms.

Governing law

These Terms are governed by the laws of Ukraine, and disputes we cannot settle between us are subject to the courts of Ukraine.

If you are a consumer resident in the EU/EEA or the United Kingdom, this choice of law does not deprive you of the protection of the mandatory consumer-protection rules of your country of residence, and you may also bring proceedings before the courts of that country.
